We may hold your personal data for a longer duration if and to the extent such data must be stored for a longer period due to tax, commercial storage and/or documentation obligations arising under legislation or where holding your personal data is required for the assertion of claims, examination, processing or defence against any liability claims that may reasonably be expected within the applicable limitation periods. Holding of your personal data in this context therefore constitutes a legitimate interest.

We will not retain and process your personal data other than for the purposes set out in this privacy policy. When it is no longer necessary to retain your personal data, we will delete or anonymise it.

Who we share your personal information with

We do not share your personal details with companies, organisations and individuals outside Watch Collecting, except in the following circumstances:

  • Where a watch has been lost or stolen, we may share your information with the Art Loss Register, the police or other law enforcement agencies in order to try and recover it. A lost or stolen watch can be searched against the global Watch Register in order to try and locate and recover the watch. Further information on the Art Loss Register is available here;
  • We will share personal information with law enforcement or other authorities if required by applicable law. We may share your personal information with the parties mentioned in this privacy policy for the purposes set out.
  • We may share your personal information with other users of our website in order for us to introduce the seller of a watch and the successful bidder on the watch, and with Stripe. Where your personal data is shared with third parties such as Stripe, the processing of your information will be governed by their privacy policy. Stripe’s privacy policy is available at: https://stripe.com/gb/privacy. We do not share more personal information with them than is necessary.
  • We share your personal information with our group entities, where necessary.

Our third party service providers

As part of the provision of our services we use third party service providers, such as our website hosting provider. They perform the processing on our behalf on the basis of our privacy policy, confidentiality and security measures and we do not share more personal information with them than is necessary.

Whether information has to be provided by you, and if so why

To create an account we require your name and email address. If we do not have this information we will not be able to create an account for you.

If you wish to list your watch on Watch Collecting we will require you to provide your name, an email address and details of your watch to enable us to consider your watch and create a suitable listing. If we do not have this information we will not be able to create a listing.

If you bid in an auction we will need to process your payment details in order to process the fee payable to us if you are the successful bidder. If we do not have this information, your bid will not be accepted.

Transfer of your information out of the EEA

To deliver services to you, it is sometimes necessary for us to share your personal data outside of the United Kingdom or the European Union, including:

  1. with your and our service providers located outside the United Kingdom or the European Union, such as website hosts or photographers (where applicable);
  2. if you are based outside the United Kingdom or the European Union;
  3. where there is an international dimension to the services we are providing to you, for example if you are a Buyer of a watch and the seller is located in a different country (or vice versa);
  4. our third party payment provider, Stripe, may process and store your personal data outside of the United Kingdom or the European Union in accordance with its privacy policy: https://stripe.com/gb/privacy.

Under data protection law, we can only transfer your personal data to a country or international organisation outside United Kingdom or the European Union where:

  • the UK government or, where the EU GDPR applies, the European Commission has decided the particular country or international organisation ensures an adequate level of protection of personal data (known as an ‘adequacy decision’);
  • there are appropriate safeguards in place, together with enforceable rights and effective legal remedies for data subjects – for example, the standard contractual clauses or “model clauses”; or

We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it.
